These Terms of Service (the "Terms") are an agreement between you and [Dead Simple Hosting — legal entity name pending] ("Dead Simple Hosting", "we", "us") governing your use of our game-server hosting services, websites, and control panel (together, the "Service"). By creating an account or using the Service you agree to these Terms, our Acceptable Use Policy, our Privacy Policy, and our Refunds & Cancellation Policy, which are part of these Terms.
1. The Service
Dead Simple Hosting provides managed Minecraft server hosting: we provision, run, back up, and maintain game servers and multi-server networks on our infrastructure, and give you a control panel to manage them. Plans are priced by allocated memory as described at checkout. Some capabilities are marked early access in the product; those are provided as-is while we finish them and may change or be fulfilled manually.
2. Your account
- You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
- You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create an account. If you are under 18, you need a parent or guardian's permission and their payment method used with their consent.
- Notify us promptly through the support page if you believe your account has been compromised.
3. Plans, billing, and payment
- Paid plans bill monthly, in advance, through our payment processor (Stripe). We do not store your full card number on our systems.
- Prices are shown at checkout. We may change plan pricing with at least 14 days' notice; changes apply from your next billing cycle.
- If a renewal payment fails we will retry and notify you. Servers on unpaid subscriptions may be stopped after the grace period shown in your billing settings and their data handled per Section 6.
- Cancellation and refunds are governed by the Refunds & Cancellation Policy.
4. Your content
Worlds, configurations, plugins, uploads, and other content you place on your servers ("Your Content") remain yours. You grant us the limited rights needed to operate the Service: to store, copy (including to backups), transmit, and display Your Content as required to host it for you. You are responsible for Your Content and for the conduct of players on your servers, including ensuring you have the rights to any modpacks, plugins, or other material you install.
5. Storage, backups, and data durability
- Shared-hosting storage grows automatically with your world, up to a fair-use maximum of 200 GB per server. The panel notifies you well before the maximum; at the maximum the server is stopped until usage is reduced (the file manager remains available while stopped) or the server is moved to dedicated hardware, where storage is sized to your order. Backups do not count toward this maximum.
- We take automatic offsite backups of eligible server data on a rolling schedule (currently about every 30 minutes for worlds and managed databases) and retain them on a tiered schedule (dense recent points, thinning to roughly 30 days).
- We test that backups actually restore through automated nightly restore drills, and our systems alert us when a backup or its restore-proof goes stale.
- Backups are a recovery mechanism, not an archive guarantee: a restore returns your data to the most recent good backup point, so up to the backup interval of recent changes can be lost. You can also take manual backups and download your data from the panel.
- Despite this engineering, no backup system is infallible, and except where required by law we do not warrant that data can always be recovered. Keep your own copies of anything irreplaceable.
6. Termination, suspension, and data retention
- You can cancel any time from the panel; see the Refunds & Cancellation Policy for how cancellation and post-cancellation data retention work.
- We may suspend or terminate servers or accounts that violate these Terms or the Acceptable Use Policy, that create security or legal risk, or that remain unpaid past the grace period. Where reasonable we will warn you first; for severe violations (Section 2 of the AUP) we may act immediately.
- After a subscription ends, associated server data and backups are retained for a limited window (currently [14] days) and then permanently deleted.
7. Minecraft and third parties
- Dead Simple Hosting is not affiliated with Mojang, Microsoft, or Minecraft. You must comply with the Minecraft EULA and applicable third-party terms (modpack licenses, plugin licenses, Xbox Live terms for Bedrock players).
- Crossplay support relies on community tooling (GeyserMC/Floodgate). Where crossplay is enabled, Bedrock players authenticate through Xbox Live and Java-edition account verification is handled differently than on a standard Java-only server — see the in-product note where you enable it.
- The Service depends on third-party providers (payment, cloud storage, connectivity). Their availability affects ours.
8. Service availability
We aim for the Service to be available continuously, but we are a young platform and do not yet offer a contractual uptime SLA. We may perform maintenance (with notice where practical) and may modify features as the product evolves. We publish what our systems can actually prove — where a capability is not finished, we say so in the product rather than promise it here.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA; AND OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we will give notice (email or in-product) at least 14 days before they take effect. Continuing to use the Service after changes take effect constitutes acceptance.
12. Governing law
